Terms of Service
Last updated 31 Oct 2026 · version 2026-10-31
These terms are an agreement between you (the photographer or studio that creates a CullTone workspace, and everyone you invite into it) and CullTone ("we"). By creating a workspace or accepting an invite you agree to them.
1. What CullTone does
CullTone helps you go from camera files to a client gallery: it sorts photos into Keep, Review and Archive with a reason, edits them in a look you choose, checks the results, and publishes a gallery your client can view, favourite, approve and download. Most of the work runs on your own computer in CullTone Desktop. The cloud service holds your account, your projects' small previews and decisions, the finished photos you deliver, and the client galleries.
CullTone's suggestions are suggestions. You decide what is kept, edited and delivered, and you check the results before your client sees them.
2. Your account and your team
- You must give a working email address and keep your password private. You are responsible for what happens in your workspace.
- The workspace owner decides who joins and with which role. Owners, editors and reviewers each take a seat; clients don't.
- You must be old enough to enter a contract where you live, and use CullTone for your photography work.
3. Your photos stay yours
- You keep every right to your photos and edits. We use them only to run CullTone for you: to analyse, edit, store and show them to the people you choose.
- We never use your photos or your clients' faces to train AI models, and never sell them.
- CullTone never changes your original files. Archive is reversible, and nothing is deleted without an action by you, except as described in section 6.
- CullTone Desktop remembers where each project's originals are on your computer. Those folder paths stay on your computer (except in crash reports, see below); the service only knows a short name for each place and whether it can be read.
CullTone Desktop sends us a crash report when it stops unexpectedly, to help us fix it. It never holds your photos, and you can turn sending off in the app. What a report holds and how long we keep it is in the Privacy Policy, section 4.
4. Your responsibilities for the people in your photos
You are the one who photographed the people in your projects, so you are responsible for having the right to use those photos and to share them with your client, including photos of children. For your clients' personal data we act on your behalf and on your instructions (see the Privacy Policy and our data processing terms).
5. Face grouping (People)
People is on for new projects. It compares the faces within one project, and only within that project, to group photos by person, so you can find everyone and check that no one was missed. The face fingerprints stay in that project and are never compared across projects or workspaces. You can turn People off for any project at any time; that deletes its face fingerprints. By accepting these terms you confirm that you may use face grouping for your projects where you work, and you will turn it off where you may not.
6. Storage, galleries and deletion
- Each plan includes cloud storage. Galleries, previews, ZIPs and every other file we keep for you count. Photos on your computer don't.
- When the storage is full, existing galleries stay online, but new galleries wait until you free space, add storage or upgrade. We never charge you for going over.
- A gallery stays online for 6 months unless you pick another date, and you can extend it. Thirty days after a gallery expires, its gallery copies and ZIP are deleted to free space; your edited photos stay in the project.
- Originals uploaded to the cloud (cloud projects) are deleted after the retention period you set, counted from the last delivery, after a warning in the app, unless you turn on "Keep originals".
- An archived project can be restored for 30 days. "Delete permanently" removes it and its files and cannot be undone.
7. Paid optional steps
Some optional steps are paid and processed by Google (Gemini): breaking ties between similar photos, and creative retouching. Each one shows its price first and only runs after you approve it, within the spending caps you set. The photos needed for that step are sent to Google to process it. Results made with generative AI are labelled as AI-modified in the app, in the gallery and in the file metadata. You are responsible for telling your client when a delivered photo was changed with AI where that is expected or required.
8. Plans and payment
Prices are in US dollars, the same everywhere, billed monthly (plans today: Free trial $0, Solo $9, Pro $19, Team $49, Studio $89; see Pricing). Taxes may be added where required. Paid optional steps are charged on top, only after you approve each estimate. You can cancel at any time; the plan then runs to the end of the paid month.
9. Acceptable use
- Don't upload photos you have no right to use, or anything illegal, including any sexual content involving minors.
- Don't use CullTone to identify, track or profile people, or to make misleading images of real people.
- Don't try to break, overload or get around the limits and security of the service, or access other workspaces.
We may suspend a workspace that breaks these rules, and will tell you why unless the law prevents it.
10. Availability and liability
We work to keep CullTone available and your data safe, but the service is provided as it is. Keep your own copies of your originals and finished work.
11. Changes and contact
We'll tell you in the app at least 30 days before a change to these terms that affects you. Questions: use the contact form.
